Long story short: my common-law ex and i had a son and ended up giving him my ex's last name. He also signed the birth certificate. Now that we seperated I'm fighting for primary custody. When I am granted this, am I allowed to legally change his last name to mine without his consent? Please help. Also we're in Canada.

that's why i left my ex off my son's birth certificate. and he has my last name. it's easier to add stuff than change it.
and you can't change his last name without the consent of your ex unless he gives up his rights, at least in the united states.

As angry as you are with your ex, why try to explain to your son why you chose to deny him a fathers name as if he were a dog in the street. It doesn't matter where you are, kids like knowing their mom knows who their dad is. Primary custody won't change his name, it must be done legally, but primary custody won't mean that your ex is permanently cut out of his sons life. If he wants visitation, he will get it. For the sake of your son, don't continually bad mouth his dad. You don't have to be more than polite, but show him how an adult in a difficult situation behaves and he will grow up to be a man you can be proud of, because hes had you as a role model.

Nope--he's on the Birth Certificate- and more importantly -- he's his biological father. You can't just change the kids name without dad's approval. Make sure he pays you child support when you get custody. That's the way works in America anyway. You attorney can answer this easily for you. Good Luck!
Why would you want to change your son's last name anyway--it's who he is.

I researched this once, the attorney that I spoke with told me that I could change the first name but not the last without the fathers permission. One way to do it is to put a legal ad in the paper for so many days and if he don't respond then you can do it. But, check with an attorney first!

Not without the fathers consent. He will always be our son's legal parent ( unless he legally wavers all his parental rights).Only then can you change the boys last name.

The child is still his child and you have to get him to let you adopt the child in order to change his name. Is his name on the birth certificate. That his child as much as it is yours , you can't go changing names just because you want to.

i do believe you will need your ex's signature to change the last name. Why don't you want your son to have his rightful name?

It really depends on wether or not the baby knos that his or her nome well because if the baby knos its name i think the best thing to do is to just throw yours in ther somewhere

Probably, however a judge would have to approve it and I don't think they would. It's still his father.
