Is it necrophillia if the person that you are having sex with is still alive but he/she just lays there like a dead fish, or if he/she is a republican

Yes, it's a misdemeanor, but still illegal. Just as beastiality is a misdemeanor. But the bigger problem here is the psychological issues. The man could probably claim a psychological state to allow the charges to be expunged.
P.S. How do you keep the body warm enough? And what about lubrication? I could never get around that part myself . . .

At that point, the person can no longer give consent. Thus, it is illegal.
