I bought an item on ebay from someone who only accepted personal checks (usually I do paypal!) so I sent him the check on November 29th for $51 dollars and the check cleared on December 1st. Now he was shipping from the states so my package should have arrived already and I have sent him numerous emails with my address in case he didn't have it and asking if he had sent my package. I thought I could trust him because he had over 8000 postive feedback. I want to do something more than leave a negative feedback, is there someway I can report him on ebay? if so, how? should I wait a full month to see if my package does come? Because what if I leave a negative feedback now and then he decides to not send it. please help!

(1) If it shipped around Dec. 1, it may still be too early to tell, because Christmas season slows down all mail services.

(2) But generally after you request it, valid sellers will send you an email with info on when the package shipped, and also will provide tracking # if you ask.

(3) Make sure your email indicates that this is the "fifth attempt" to contact you by email and "failure to respond in 5 days will cause you to report to ebay as fraud." Write URGENT: RESPONSE NEEDED TO EBAY SALE # _____ in the subject line to make sure it stands out. If the person is just behind on replying to emails, this should be clear, in all caps.

(4) Go to complaint section on Ebay and report using the procedures as specified. Include proof, such as copies of emails you sent, to back up your claim that the seller has not responded. You do not have to leave negative feedback yet, but let Ebay know right away that you will dispute the sale if no reply is received. It is very important that you do this, since it may take several customers complaining before Ebay can detect a fraudulent seller.

(5) Note on feedback -- Fraudulent Sellers can stack their references with false feedback from accounts they control themeslves or through other colleague or friends, so you cannot tell by looking at this. Sometimes you can spot real feedback because the person writes specific details.

(6) I always pay using Pay Pal / Discover Card so if there is an issue, I can refuse to pay. I only had one bad experience where a cancelled sale got marked on my record instead of the seller's.

The jewelry site said "free shipping" on the picture of the item, but had restrictions in small letters underneath elsewhere on the page that did not clearly apply to the sale item. I had already paid the agreed price which was transacted through Pay Pal, but the seller later refused it and demanded more money, so the transaction was cancelled. Ebay never did address my claim of false advertising, so the bad mark was put on my account instead. The feedback section was so full of generic positive feedback, even if I submitted one complaint it would not show up. So I'm glad I used Pay Pal which allowed me to cancel it without paying, even though Ebay failed to address the problem or complaint. They have so much traffic, they probably can't monitor every vendor individually, except if people like you issue several complaints about the same vendor.

Get his contact infromation from ebay.

http://pages.ebay.com/help/buy/questions/contact-seller.html

Then contact him. If his information is out of date or wrong, then notify ebay and they will suspend his account until its updated

Contact your bank to do a stop payment on the check (even though its cleared, they can trace it to see whom has cashed it and notify the other bank that its fraudulent)
