i live check by check and in the beginning i didn't want to, but know i said forget it,but the thing is that we only have debts thats all we have and i'm sure that somebody is helping her (you know what i mean)because we don't have money like that.she abandoned me and left me with the rent and everything, i 'm going crazy.and i'm pretty sure even though we don't have kids or anything exept debts is going to be contested and thats the point that i don't have enough money to hire a lawyer,don't qualified for legal aid either... any comment will be helpful thanks

I don't understand the problem. You have to notify your credit accounts of a legal separation so that she cannot charge up additional bills you are required to pay on her behalf. They will probably open a new account if you need one but my advice is to cut up the cards all togetherand freeze the accounts so no additional activity can occur. She is still equally financially legally responsible for debts in common. If she wants a divorce then she will pay for it. You are not required to file unless it is in your interest at a later time if you find someone you would like to marry.... but wait a while before you even begin to look and get your emotions and financial house in order.. You have no assets ... there is nothing to divide up but bills. She left you so there is no alimony.

At least at this point in time, although you only have your income, you don't have her draining any of it away. Your bills still may be more than you can afford so call creditors and restructure your debt, get a second job and be out from under a large mistake. Once cleaned up, get some more education or a trade school training so paycheck to paycheck living can be a thing of the past

I am not an attorney but you can check with legal aid in your county and find out what I am telling you is a fair assessment of what you need to do and it costs you nothing or marginally to do it. .. good luck

You don't need a lawyer and there is nothing to contest. Assets are what cause problems not bills. If the two of you can not come to an agreement on who pays what bills the judge will do that for you (as close to down the middle as he can). You may actually come out ahead if she currently is not helping on any of the bills. As for rent, you may have to look at finding a cheaper place or roommates. It seems overwhelming at first but sounds as though you have already been living apart.

You can get an online divorce for under $300 and in some states all you have to do is publish an intent to file for divorce in the local newspaper and if the other party doesn't respond to the ad you get the divorce by default. Research the laws in your state and you'll be able to figure out a way to get it done as inexpensively as possible. Or you could wait it out. Wait for her to file. The one that files usually pays for the costs.

There is a difference between an appointed attorney and legal aid. A legal aid is designed for a person who is representing themselves to give them a push in the right direction. They will give you an idea of what the laws are in your state. Good luck.

It doesn't sound like you'll have anything to contest ... I'm confused after reading your question. What might be contested? And why can't you get legal aid? When my ex and I divorced, I didn't have to pay a dime. I just happily signed the papers.

It’s going to be contested by who? You said she’s the one filing. Why would you contest it?

Just make sure she’s held responsible for half of your martial debt.

Maybe see if you can find an attorney that will take payments. I *really* don’t know if that’s possible, but make some phone calls.

hmm, if your income is as low as you say, you should be able to get legal aid. well, just try not to panic yet. you may not get stuck with all the debt. even if you dont have legal counsel, speak up if given the chance when it goes to court. hopefully the judge will give you a chance to say something on your behalf.

Contest the Divorece. You don't have to do anything. If she files for a divorce from you, then you have to agree and sign the papers. Do not sign anything.
