where do we stand with liabilty if theres subcidence/heave etc ? who would be liable.do i need to imform my insurance company?

Your question's not too clear.
However, I assume that someone has built close to your boundary. If this is the case, they should have issued you with a Party Wall Agreement, which has to clearly state what they are doing and what steps they intend to take to avoid causing damage to your property.
Failure to issue a Party Wall Agreement is actionable at law.
If you believe that you have subsidence or heave damage due to actions of others, take photographs, inform the builder, the local authority and the house owner and your insurer.
The person who has caused the damage is liable. You may have to appoint a structural engineer to state your case, but if you have a strong case, it will be worth paying his fees.

I can sympathise with you 'cos next door was an old people's home and there is massive construction which have left cracks in our house. I think the council was informed, we also bought the construction firm over to see the damage they caused.
