You can still file for divorce on abandonment charges. Even if he refuses to sign...and especially if he doesn't show up in court, the judge will grant you the divorce.

File the papers. Even if he doesnt sign and show up in the court you will eventually get a divorce by default. Divorce will take long, you will require lot of patience. But you will win.

A couple of people said this already, but just to reassure you--you will get the divorce. My ex threatened me by saying he wouldn't sign and he wouldn't come to court. He had moved out of state. He ended up signing, but I found out that it wouldn't have mattered. It just takes the process a little longer, but you will be granted the divorce.

Then it goes into default.(just means he was served an refused to sign) He doesn't have to sign he doesn't have to show up to court. My ex didn't even know we were divorced for 3 months, when i got mad and told him..oh BTW we've been divorced 3 months!

You will have to start a claim to take him to court and once they grant you a court date and if he doesn't show, then they will grant you the divorce, it's a long process, doesn't happen over night.

You win by default... you get everything you asked for. It usually takes longer to get the divorce, but not much longer.
