I work for labor ready and work a job that is 4-10hr shifts. I get paid daily and was getting 2hours of overtime each day because shift was more than 8hrs. labor ready now is paying me daily for 10hrs with no overtime is this correct? I also work with others from labor ready at same job and hours and they get the 2hrs of overtime and I do not.

Call the State Employment office in your area and ask for the legal definition of overtime in your state. It varies from state to state.
In many places its more than 40 hours in one pay period.

As far as I know, overtime, LEGALLY, is working (physically) anything over 40 hours a week......and does NOT include how many hours a day.

If an employer wants to work you 10 hour days for 4 days...there is your 40 hours...no overtime. OR.....5 days at hours a day....it all adds up to 40.. but getting it BEYOND 40...that is another story.

If they choose to pay you overtime for anything over 8 hours a day, then consider yourself lucky. It isn't something they aren't required, by law, to do.

If you are questioning the other employees' pay, I would go right to your immediate supervisor and just simply ask "Is the 2 hours of overtime done away with...I was just wondering since the others' are getting it". But don't be defensive..just ask. They will answer!

EDIT TO ADD: this applies to HOURLY employees. A salaried employee can work as many hours as they want to. However, some employers, again, will give extra perks such as comp time, etc. But again..NOT LEGALLY REQUIRED.

Everyone has a set number of hours that they are suppose to work a week. I'm a salaried employee and work 45 hours a week. If I work more then that, I get my overtime given to me in time off.

For hourly employee's, if your says you must work say 40 hours in a week but work 45, then 5 of those hours are considered overtime and are generally payed time and a half.

Bring it to their attention, say something like, "I know you didn't mean to violate labor law when you forgot to pay me this overtime."
