I was receintly diagnosed with conjestive heart failure and while I was in the hospital the sherriffs office served us papers but I never received them because my son received them and for fear my condition would worsen he did give them to me until it was too late. I undergo heart surgey the day after christmas and I am supposed to vacate by Saturday 12-15-06. I feel I should appeal this decision I am on section 8 housing and physically and mentally can not handle this and I dont know what my children and i are gonna do. So how do I appeal this and whom should I contact for help. Local agencies appear to have no rent assistance available at this time

Contact your Dept. of Human Services they should be able to help you and put you in contact with different services that can help. Sometimes there are County services and Churches that will help. Good Luck and hope you get better soon. Merry Christmas

Call a lawyer--they might give you some quick advice. Other than that--go to or call the court in which the eviction order was made and ask them directly. I'm sorry to hear about your condition...but that might not really matter, at this point. I'm not really sure what the situation is in regard to why you were served an eviction notice in the first place. You might have to directly go to social services. I do know that in NYState they are suppose to at least give you a month before eviction--eviction is usually given for non payment...and I would assume that a Section 8 would at least give you some time to catch up (If you COMMUNICATE) before they go to a court and seek to have you evicted. I would be very upset with your children for keeping that information from you, regardless of your condition--since this could well mean that they are going to be out on the street for Christmas. Another venue is to talk to the people that you have to pay your rent....you can try to persuade them. You should have talked to them in the first place. Good luck!

I dont know about your state, but in GA you have 10 days to file an appeal with the court that signed the eviction notice.

Then there will be a hearing and the judge will decide when you have to move out.

The eviction papers should have a number or something. Contact your local courthouse magistrate's office and or the probate office, they will be able to answer your questions

Sat is not the 15th, today is. I've never known Section 8 to make arrangements for late rent. Considering your circumstance though, I would appeal this to the Section 8 Director, CC his/her boss. (Do so even if you're evicted so you might at least get your placement back instead of having to reapply.) Also check with Job and Family Services regarding PRC or ASSETS assistance. You might phone social services and get names of local churchs or homeless shelters that might also assist til you can get back on your feet.
