I have been signed off by my doctor for 2 weeks but have been getting harrassed by my work to sort out rota's for the next few weeks. I have been called 3 times in one day so far. I didn't think that they were meant to contact you? Probably is a bit petty but just wanted to know. Any help?

Yes they can contact you. They need to check that you are indeed ill.
If however, they are calling you with a work-related problem, like you describe, then you can ask them to sort the issue out themselves. It's not fair to be harrassed in this way.

Your right, You are being a bit petty; emphasises on the BIT.

Your employer can contact you to check you are sick, to see how you are doing, and to make arrangements to allow you to come back to work in a comfortable way to you. The latter is what you describe above.

As a rule, they cannot contact you for work tasks like booking an appointment with a client, describing the latest goals etc. These are work tasks that will need to wait till your return.

If you don't really feel well enough when they call, explain that now is not a good time, and could they call back at XXXX time. You should be glad that they want you to have an input in your Rota for your return.

Stop acting against them and work with them.

They can contact you about you being off sick and when you will be back, what they can do to support you etc but I don't think it is fair they are contacting you and asking you to work (sorting out the rota for the next few weeks is classed as working to me) soI think they are being unfair. If you are sick and have a valid sicknote, they should not be asking you to do this. Sick means no work including rotas.

Strictly speaking your firm is acting illegally is asking you to do any work while you are signed off.

When I was off work for 9 weeks I tried to stay involved with work, and they told me to go away! Apparently if I had done any work and had suffered a relapse as a result I could have sued them.

Personally, I'd be happy to help out unless I was really very ill. And also you probably don't want to p*ss them off in case it affects your future prospects.

But as I say, they shouldn't legally be doing this.

If you're in the UK, employers have a "Duty of Care" toward ALL employees. That duty includes having to allow you time to recuperate from properly certificated absence for ill-health.

Asking you to conduct any of your contractual duties during this period of certificated absence is a breach of their Duty of Care, and they are (perhaps unwittingly) putting the Company at risk of legal action being taken against them (such as an injunction to cease contacting you) and payment of compensation for endangering your rate of recovery, as well as allowing the possibility of answering to a case of constructive dismissal.

How you proceed with your legal and civil law rights should be balanced with your needs now and in the future.

You may wish to seek advice from a Citizens Advice Bureau (IF, and only IF, they have experienced employment law advisers) or a specialist solicitor.

There isn't really anything to say that they can't call you, but they have to be reasonable about it and asking you to work while you are off sick is maybe not reasonable.

I would let them know that, while you are sorry to leave them short, you are unwell and can't recover while they are calling you so often. Then agree something that is reasonable for you both - maybe you call them every other day at a good time for you instead.

Wal-Mart store employees aren't allowed to be bothered if they are home sick or even if they have the day off. If they are contacted, the person contacting them must let payroll know so the person is paid for it. But this is the only place I have ever heard of it.

Surely you are too ill to be posting on here!!

I am not sure if there is legislation but if you are important to the organisation then they are able to contact you to ask any pertinent questions. It is probably in your contract somewhere. I would help as much as possible personally as it will help with your review when it next comes round but if you are too ill tell them and then ignore the phone.

I don't know what rota is, but I'm pretty sure they can call you, as long as they don't try to force or guilt you in to working. Then it's harrassment!

Yes they can contact you. Maybe they're concerned about your health, maybe they need to check with you about something at the job. They can't harass you, but have every right to contact you. Don't make a big deal out of this. Just remember you have to work for this company when you're healthy again.
