Better Business might not have much pull with the company. How did Frank pay for the item(s)? If it was on a credit card, ask him to call the card issuer and see what can be done to contest or stop the payment. Did XYZ give him a warranty? If so what were the conditions on the warranty?

Also, consider that the machinery was damaged in transport. If he handled the transporting himself, your friend is out of luck. If the XYZ Co. choose the delivery service, then they need to work out the problem with the delivery service.

What kind of machinery are we talking about? Vehicles might fall under your local Lemon Laws. Has Frank tried taking the machinery to a local repair shop? If for no other reason than to figure out how much the repairs would be to make the item(s) work properly. This would be the figure he has the best chance of being awarded.

Demand from XYZ for the whole amount of the equipment since it was not working. If the company do not pay, then file a collection case in the small claims court for the said amount. When an unfavorable decision is granted by the small claims court, appeal it to the higher court.
