This is a complex question. Many scholars argue that sovereignty is taking on new forms today, and that the territorial state is no longer the container of sovereignty. Rather, there is 'flexible' sovereignty, in which the exercise of power by any state or international organization is justified during the sovereign act, rather than assumed in advance because of the territorial structure of the institution. Power is operating in new forms today, and we are only beginning to understand these. Hardt and Negri's "Empire" is a dense but accessible account of some aspects of contemporary practices and justifications of power.
