my lawyer sent in the order for support to be automaticly withheld from his pay, so when do i start recieving it. And I was awarded back support since october, do I get the back support in a lump sum or is it added to the following months...?

To Jake I dont have a fat a** and I do work. My jerk husband had a girlfriend and is a lying cheating snake who is now going to pay through the nose.

It depends on the guy. It could be never, if he decides not to work or finds a job where he can get paid cash. File with Child Support Enforcement and let them chase him around. Chances are they'll make an arrangement on the back amount. He can't pay you a lump sum if he just doesn't have it.

I guess my ex didn't know you have to pay the back child support, because after 18 years of him not paying, I started getting a check every 2 weeks. He must have gone out and gotten a legit job as soon as the kid turned 18.

When the courts receive the papers from your attorney ( they are not always timely in sending then & will lie to you), they will process the paperwork. In my area that takes 3-5 days after receiving, then his employer will be notified & given 5 days to start withdrawal. Depending on the capabilities of the employer, if they can do an automatic deposit to county or if they have to mail it in then the county must put it in their system. The first payment can take 2-4 weeks. Our county will send someone to social services for temporary relief sometime while they wait. Paperwork is crazy & does take time unfortuately.

They can not deduct the entire back pay. The court should have set a repayment plan.

You will start receiving your support monies as soon as the non-custodial parent receives a pay check.

For example, if the non-custodial parent received a check on Friday than your support monies will be deposited in your account that day.

As for back support, you may want to contact your Family Court or Probation Department to inquire when you will receive these monies.

Legally they cannot garnish the whole check of the non-custodial parent so you may not receive a lump sum. It may be added on to your regular support payments.

This would be paid into a child support unit so call them or call the lawyer and ask how long it takes and how much you can expect since you have not received it since October.

It all depends who he has to sent the money thru, It really just depends on the court system also, If you have a phone nunber for your local child support agency I would call them and they will piont you in the right directionm AND THE MOST IMPORTANT THINg, don't give up call eveyweek untill you start seeing it and even after that Good Luck
