Whichever gender the intersexed individual is living as will be listed as his/her "official" gender. In most cases, there are no police who descend down out of thin air when someone discovers they are intersexed (genitally, as sometimes shows after puberty, hormonally, or chromosomally, which must be tested) to challenge their gender, you know? And if they've known from birth, then they have chosen one to be aligned with, at least in an official sense, and their driver's license and government papers and all that will designate male or female, and hence they will be sent to prison.
Hope that helps!

Whatever is on their identification determines where they're sent. Many have one of the two sets removed at a young age and the doctors and parents hope they chose the right one for their child so that their body, mind, and legal documents match. Oh, and as far as I know there has never been a *true* hermaphrodite. (Someone born with both complete, working sets of genitals.)

she would visit an all lady reformatory . putting her right into a male reformatory will be construed as merciless and unusual punishment . even with the very undeniable truth that a do imagine all rapists and newborn molesters must be required to undergo sex reassignment and then serve a extremely decreased sentence in the final inhabitants of a male reformatory. you ought to guess they'd come out then with authentic empathy for his or her sufferers

The legal definition of one's sex varies from state to state. In New York, it's determined by whether or not you urinate through a penis. Interestingly enough, the laws on transgender persons getting married (and staying married) also vary from state to state.

Probably sent to whichever one they are currently identifying themselves as. (If they are acting in society like a woman, they would get sent to female prison and vice versa.)
