Alright i am 26 years old and married now for three years and happy.I have two great kids 6 year old daughter and 2 1/2 year old son.My daughters biological father pays child support but has never met her only seen her a few times and she calls my hubby dad.Her biological dad told me when we were dating he was divorced when he was really still married just seperated at that time i found out dumped him .At any rate he has contacted me a number of times calling to see how his daughter was.His wife aparently had no idea he had a child or that he had ever had an affair.She is harassing me calling left 55 voice mails and even came to my house.For some reason she wants co-custudy of my daughter with her husband!?

I dont see the reason why she wants anything to do with my daughter!and i want her to leave me alone!?My husband is very frusturated by this and its causing stress on us both.

Well, I guess your ex has a right to apply for it. She can't, legally. She has no rights nor is there any reason (i.e. Children's Services files or case) for someone who is not biologically tied, to get custody of your child. Harassing you is pointless and it seems like it is really not about getting custody as much as it is about being VERY angry that this all transpired. She probably feels betrayed and this is how it is manifesting. If she was serious, she wouldn't be bothering you, she'd be trying to convince her husband to go to a lawyer to get the process under way. And as I've said, if there is no Child Welfare file on you, only HE has legal right to do that. And quite frankly, especially if you live in USA, fathers don't have much chance of gaining custody of their children, unless there is severe abuse, drug or otherwise. ESPECIALLY if he deems to be wanting custody 6 years later. The most he would get (If he were to actually go through the process) is access or maybe joint custody with you. You would most likely be the primary care giver. That is just my unprofessional opinion. Talk to a lawyer. But as I've said, she is probably just acting out because of her anger.

Don't worry this would be extremely unlikely, they only way this would happen is if you agreed. You are all this child knows and a judge will know that. Getting a restraining order and call it a day. Don't even let this ruin your life. It is not worth getting stressed over and completely quit communicating with this women.

She has no right to ask for anything take out a DVO against her harassment and based on the fact your daughter never has seen her dad he shouldn't get more than supervised visitation maybe leading into weekend or holiday contact...seems she wants to see the kid more than he does but she has no rights. BTW also if it gets legal ask for more support that normaly backs them off.

Time to talk to a lawyer.
First, get a restraining order for her to stay away and to stop calling.
Second, find out if there is any grounds for her to try and get custody. Fight for your child! Don't let someone like her take your child from you.

I would first consult an attorney, just to be on the safe side. She does have alot of nerve. I certainly would file harrassment charges against her. Keep up with your voice mails and document all calls etc.....Good luck
