Should this be the law of the land?
In order for the voters wishes to still be valid ,does not appointing from the other party infringe on voter rights, in the sense that this invalidates their votes?
As the Supreme Court ever dealt with this Issue?

SD governor can only appoint someone to replace Johnson if he dies or resigns.

No....he should appoint whoever he wishes. Let him make the choice of the person.
Should it be a law....no. Though a law that said any appointment must be an independent would be nice.
Well....you can't guarantee a person will full out there full term. And a 'must be same party ' law would just cause problems of stacking the deck(a party could wait for the last minuet...dump all the ones in a state, and automatically replace them).
This has never come before the SC, at least not in recent times. It's quite rare anyway.

The governor was elected by the people too. Also, this is the state constitution which was approved by the people. It would be unconstitutional to do it any other way. So the law must stand, even if some Demo's dont like it.

The voters made the rules. They didn't make that rule. And no one has any idea how voters would have voted on a particular other Democrat OR Republican.
