My dads wife of 14 yrs. left him not letting her whereabouts be known. She is renting an apartment has bought herself new furniture and new vehicle '06. My dad suffered mental anguish and all that good stuff that comes with pain. After 7 mths pass my dad finds a girlfriend & moves her in. His wife has come to the house on 3 seperate occasions & has picked up practically everything in the house just leaving bedrm. set my dad bought, livingrm. tv, & 1 sofa. The last time she came she yanked ALL curtains off including the shower. Not mentioning asking him to pay off all her credit cards before showing signs of her leaving him with his retirement $. So she took all his retirement $ closing that acct. transferred her 401k into her daughters bank acct. My dad has not worked in the last 4 yrs. Looks like this was a plan. Now my dad is stuggling for $ selling his horses, cars, jewelry,tools,etc. Can she file adultry on my dad or can my dad file abandonment?

Something like adultery would be very hard to prove...unless a DNA test is done on an unborn child.

First off, your dad needs to do the following:
File a police report about the thefts. Once his wife left the premises, anything she returned and took was theft.
Change the locks so that she cannot get in the house again.
Determine of his retirement account was held jointly or solely in his own name. If it was held in his own name, as is typical, what she did was a crime, and she should be prosecuted.
Adultery is not a crime, and none of your father's actions AFTER she left are grounds for divorce.
Your father needs to act immediately to protect his financial interests.

Depending upon the nationality, your father may be able to file for divorce, or abandonment. If these are legal options, this should be done quickly. Either a fault based, or no fault divorce. This is because under the law, your father is typically entitled to a percentage of the commonly owned property. (401K, property, $$$$$). Depending upon a number of factors, his wife may owe him alimony. Once these steps have been taken, CHANGE THE LOCKS!!

Both can press charges against eachother for both of those. It does sound like he needs a GOOD lawyer. 14 years does not constitute her taking his retirement and him having to pay off her credit cards. Now that he has done it he can't take it back but if he can get a good lawyer he might be able to salvage what he has left.

depends on your state laws but I doubt adultry would hold up. Based on what you have said, if he files for divorce the judge might make her pay back much of what she has taken from him. Only an attorney will be able to tell you what can be done and the chances of getting it done.
