What is stalking?
Behaviour wherein an individual willfully and repeatedly engages in a knowing course of harassing conduct directed at another person which reasonably and seriously alarms, torments, or terrorizes that person.
Study (plural studies)
1. The act of acquiring knowledge on a subject through concentration.
Basically one is harassment and the other isn't. Hope that helps and good luck in court.

It's stalking when you don't at least live in the same zip code but you still know what they do at 6:51 a.m. coz you see it up close.
It's studying when you both go to the same library, coz you're both in school, and just happen to always look at each other a bit.

ok, if you wished to mug someone and trailed them for a while looking for an opening that would be stalking
but, if there was a new guy in your class that you wanted to know about i would not consider following him stalking, just like you said, studying

studying someone would probably asking a few innocent questions or observing them when they are around u and stalking is going to their house, following them, and following their family
