Looking for some law advice here, and if it would be possible for any employee to sue, if there is illegal activity going on here.

As far as i know, random drug testing is illegal (now) in Rhode Island. Drug testing is only allowed if a spedific employee is suspected of useing drugs due to job performance, or it is also allowed as part of pre-employment (i think).

here is what happened: the Hotel i was working for was sold and baught by a new company. There was an official "take over" as of Nov. 1. A few days before this we all filled out aplications, as well as other documents, to be "hired" by the new company, even though we were already working there, the same staff was kept, except for some that choose to leave (mostly bosses). For almost two months we were working under the new owners, and getting payed by them, new management replaced most of our bosses. so i would assume that due to this we would be considered employess of the new company, wouldnt you think? continued....

So for two months we worked, and got payed. one day a corporate representative bursed into HR and demanded that every employee of the hotel take a drug test that day, or else they would be fired. they extended it to include the next day after complaints. they also withheld paychecks until we pissed for them. they are saying that it is stil a "preemployment" drug test and it is legal because we were given warning (which idont remember). and that are employment with them was contingent upon us passing this future test. As far as everyone is concerned we are already employees sense we are being payed, and that this company conducted a drug test illegally two months after we were hired, or so we thought. they are saying we were not offical employees, but were in some probation period until we passed this test. what do you think? also multiple people were pissing in the same bathroom a the same time. i thought this was illegal also. any advice?

I am not sure if it is illegal. I just know, that employers can ask you to do the test. I heard that Soldiers in the Military had to take illegal drugs as labor rats. If they would have taken them privately, it would be illegal. But when the government says to do it, it's legal, they had to take dangerous drugs. If they denied to take these drugs, they lost their job.

You could sue everybody. But if a lawyer denies your case you have no chance. If you go to court, you have to know how much money you want / need. Lawyers always asked me how much money I lost because of doctor appointments. Or if there was property damage how much would the repair cost.

A court will ask how much your enemy owes you.

A very good point which will drive the left wing bozo's nuts. The AZ law: Why would a law officer ask for ID status? No drivers license No insurance No car registration When are those questions asked--breaking the law or a traffic accident. The other times would be when a person is busted for a crimminal activity, like rape, murder, drugs and kidnapping which is 2nd only to Mexico City. The mis-information by the Obama administration is just short of crimminal. It is differently another lie by this administration.

well according to Rhode Island, yes that is illegal.
Did HR have probable cause? they probably didnt

You might want to get with a couple of your fellow employees and see if you can contact a lawyer about Workplace discrimination.

Sounds shakey to me, they should've notified you in writing when the new company took over. But if you are clean go ahead and pee for them.
