i am 38 years old my boyfriend is from mexico,but he came here illegally.he was working one day and immigration got him and about 50 others and sent them straight back to mexico,from the job sight.needless to say he came back becuase he has children here.i have been with him for 4 years.is it possible for him to be legal when we marry,since he has been deported before

It is going to be very hard. Even if you get married, there will be tons of paperwork for the 2 of you to fill out. You will have to fill out a petition for him to obtain a visa at first. But as he has been deported again, even if you are married, he will have to go back and through the american embassy in Mexico. The road ahead of you is going to be a long one. I believe it can take up to 1 year for his situation to be taken care of.

Additional information:
He is not going to obtain citizenship right away when you marry him. He will receive a work permit at first and then he will receive a green card that will be valid for 2 years. After the 2 years he'll have to prove to the INS that he didn't get married just to be able to come to the country. If that goes through, then he will get a green card valid for 10 years, and that is when he can start looking into becoming a citizen. He has to be a permanent resident (which is the new name of the green card) for 5 years before he can apply for citizenship.

I think its best to put marriage on hold for a while until he can claim his U.S. citizenship and obtain a green card! Your boyfriend is an illegal immigrant, and he was forced to go back to Mexico! Does this issue raise a red flag to you? Besides, if your boyfriend wants to be with his family and see his children, then he needs to do the right thing and take full responsibilities for his actions! Good luck!

If your boyfriend was a responsible adult he would go back to mexico and come her legally he is a criminal and has broke the law why do you want him. My son in law is a mexican he came here legally and maintained his paperwork legally works legally and I couldn't ask for a better person to be married to my daughter so I am not racist I just think he should stand in line with the others that are here legally
