You can draw whatever you like, using any reference you like. You don't need permission to do the drawing itself. If you were to publicly display the images though, it gets a bit murky. It really depends on how much of the original image is in yours.

if somebody is a good artist, they can make an amazing picture with Paint. If somebody can't draw to save their lives, they can have the most advanced art programs in existance, but the works will still be crap. The only thing that can make paintings better is practice, practice, practice.

they probably have been practicing a while.
using software like, photoshop, illustrator, 3d studio max, maya, combustion etc.
you can buy the software, or buy the trial or student versions, they offer for cheaper.
you shouldnt be afraid to post your work, critisizm is the best way to get motivated, to practice, and learn from your mistakes.
