We want out now, and have to wait a year. If abuse is involved, you don't have to wait, but does one get arrested? Just thought we could agree to say one is abusing the other, or both of us are just to get it over quicker.

My ex and I divorced using the same attorney. We claimed incompatibility and contested nothing. We agreed to how everything should be split and to custody. Since there was nothing contested and the reason was incompatibility, our divorce was final the very next day. The whole thing cost us $800 with $100 of it being for applying for an emergency divorce. Laws may be different in your state, but if you can settle all property and child custody between you, check into this.

Irreconciliable differences would be the grounds. Don't lie if there is no abuse, you would have to file a police report and go through all the process which would take longer. File on grounds of irreconciliable differences. There is also a 2 year waiver of separation in Illinois. Don't know what state you are in, but look up the divorce laws on the net in your state. You can file that at any time.

What State mekes you wait a year? There have to be other grounds you can come up with besides abuse! If you are waiting on a seperation time period to run to get a 'no-fault' divorce, then you need to find another attorney b/c there are so many outher grounds out there--like, uhm, general indignities.

Where do you live that you have to wait a year???? I filed in Nov. was divorced by March and this was just waiting for a court date. I would not resort to lieing about abuse to get this done. Could hurt one or both of you.

If there's abuse in your relationship and you both fight. Then you will both get in trouble. My ex and I were abusive towards one another. I made a police report and told them that I hit him too. And the arrested the both of us together. And we both had to attend anger management. It just caused another stressor to our dysfunctional relationship. And if you live together then you have to worry about, a protection order and someone has to move out. If you have kids then it's just not worth it. The city will pick it up, no one has to press charges. But it's good that your seeking some type of outside help. Honestly thats all I wanted, when I went to the police. Good Luck!!!

Yes, consequences.Don't do it. If you both want the divorce, you can get it faster in another state, maybe.
