At the beginning of the school year I was fired due to decreased enrollment at the school were I taught. The other teacher who teaches the same subject that I taught ( only two of us) was choosen to stay on in that position. She is uncertified. She has not passed all the testing that my state requires. She is not a "highly-qualified" teacher accoding to the department of education in our state. She has worked in this position over a decade. I am "highly-qualified." I passed all of the testing necessary for certfication. I did not receive any bad evaluations. All of this information is on public record for my district to see. Why does she have a job? I could not find another teaching position on such short notice. I went back to school and enrolled in student teaching. I am happy to say that I am fully certified.

Some of this may be part of the union contract. You say she has been in her position for 10 years. How long were you employed? Seniority can play a big part. Last hired, first fired is generally the rule in most union setups. You didn't say how long you've been in your position.

Without knowing a lot more about the circumstances, it would be hard to advise you. Union rules, state law and local school district policy all play a part.

If she has held the job longer than you and it is lawful to keep an uncertified teacher teaching, then she has seniority and unfortunately there's nothing you can do especially if she has obtained tenure.

I'm a little confused because usually you need to be licensed to teach.

Bottom line from my point of view, I don't think you can sue anyone.

They had to choose between the two of you and I'm assuming she had more time in than you, even though your more educated. You could file a grievence with your district but I don't think it qualifies for a law suit, You weren't unfairly let go, they had no position for you because of enrollment issues.

It could possibly be that she was chosen to stay and not you because of seniority (she was there longer than you)?
