Can it be theft by check or what? I have some law office calling giving me all this theft by check info. are they just bluffing or what? I cant pay it right now?!?!?!?!?!

I've never gotten one of those so I'm not sure, but did they make you sign paperwork when you got it? If so read the fine print, the answers you want are in there. I highly doubt they're bluffing, this is their profession, they know what they can do. Make payment arrangments and you might be ok.

First off, they can garnish any future wages, or if they have reason to believe that you never intended to pay they can file criminal fraud charges against you. They are not bluffing, although if you offer to make restitution right away they may be willing to accept a minimized payment.

When you took out the loan you signed stating you would pay. they can take you to court for defaulting.

They will call you and whoever you gave as a reference every single day at least twice daily until you call and make arrangements with them.
