In order for someone to be detained under section 4 of the Mental Health Act ('sectioned'), two doctors and either a social worker or close relative of the patient need to agree that the patient's current mental state is a threat to themselves or to others. There are additional provisos for types of diagnosis, and for emergency cases.

This allows an initial detention of 72 hours. After that, section 2 has to be invoked (following more agreement) and the patient can be further detained for up to 28 days. Following that, section 3 can be invoked under medical recommendation, to extend this period to 6 months.

During any of these periods, a patient can be discharged by doctors. There is a tribunal and appeals process.

To circumvent this process, however, there is a legal loophole known as the 'Bournewood Gap', which is the situation where a patient is admitted (apparently voluntarily) to a mental hospital, but without being forcibly detained. They are then informed that they will be 'sectioned' if they attempt to leave.

In less severe (or rapidly treatable) cases of mental illness, this can be a benefit, streamlining the process. However, it is very much open to abuse, particularly with vulnerable patients.

None really...If they are a dependant or you have power of attourney for the estate, ten you can check them in for a 36 hour observation. If it is a girlfriend that is wierd then you need a little more proof...however, if there is a domestic dispute, and she is the perpetrator and the police are involved you can petition the court to have her evaluated and placed into therapy in lieu of other punishments...

Now if you get married...that is a different stroy...check her in for the 36 hour eval period...you might become divorced shortly thereafter, but what a gas...be careful...if she really is crazy then you might wake up dead...or worse...remember John Wayne Bobbit? EEEEK!

YOU cannot send anyone to the insane asylum even with "evidence". It requires judicial due process.

I spent 2 years in one 10 years ago, some people just let things go over their heads and some don't.
I did not and i did a few silly things.
You should not joke about things like this, you don't know who you are pissing off.

OK
