I'm a law student in Singapore. Even though Singapore isn't the UK, the law of Singapore is generally the same, because the laws of Singapore are derived from Commonwealth Laws (e.g. Australia, UK, Singapore, Malaysia, etc.)

Bottom line is yes,
IF THE EMPLOYEE WAS NEGLIGENT
i) while working for the benefit of the employer (the school),
ii) there is a clear line of an employee-employer realtionship,
iii) and there was actual damage, arising from the employee's negligence.

all the above factors have to be satisfied, or else the employee cannot be sued.

the school and the employee will be sued together, based on the principle of vicarious liability.

any other lawyer in the UK will tell you the same thing i just told you, if not, MORE...

Anybody can be sued for negligence, however the onus on proof is on the person making an accusation of negligence and is likely to be very complex, lengthy and, if unsuccessful, financially crippling.

You do not indicate why you think there has been negligence so I am unable to offer any further information.

Contact the Law Society for referral to a local solicitor with expertise in such cases as yours.

Cherie Blair won a case in December where she represented a 16 y.o Shabina Begum's right to wear the Jibjab at school.
I'm sure I read that a school was sued when a child was drowned in a dinghy accident whilst on an adventure holliday with the school.

I dont think so I think it would be the schools job to fire the employe(es) but its also the schools job to watch them But it depends on the thing But anyone can be sued for neglegents

i would not ever flow to the papers. i will sue if I felt the college have been negligent if my baby died or had a severe accident for this reason. I appeared on the link and clicked at as quickly as off lower back. Son admitted drug dealing and gets kicked out of deepest college, however the dad and mom are suing. Are they THICK?? they could desire to think of themselves fortunate thats all that occurred.

It depends on if the employee was acting in accordance with the schools policy. If he was acting outside their policy you may have to sue the person responsible. It may be a good idea to make your complaint to the school first and get their response (in writing). From there you may be able to make a decision on which way to go but bear in mind that the school may well try to avoid responsibility for themselves or their employee in their reply.

It is dependent on the "situation", lets say, this employee was a Gym Teacher, and was using methods in contradiction to the school policy and someone was hurt. Negligent is a "big" word, and you would have to define it. I think whatever the situation is, you would probably have to sue the "teacher" in civilian court.

Yes, the school is responsible for hiring morons. So can be sued for it.
