I really looked into filing my own divorce. There was no question on the kids, property or anything else, but in the end I still decided getting a lawyer was the best way to do. He charged me less because it was so simple and because it was simple I asked for a discount.
Also, there is something to playing their game their way. Generally, judges are lawyers and if you're not playing 'the game' (which is what our justice system is) by their rules, they don't like it. You'll do better in the end to just come up with the money and hire one.

If you are the first one filing, you are the plaintiff or petitioner. The other person is the respondent or defendant.

Oh... I didn't notice if you were a woman or not. If you want your name changed back to your maiden name or whatever, it must be in the divorce decree in most states, or they won't change your name and it's hard to get a new Soc. Sec. Card with your other name on it. Get it in the divorce decree and it will be easy to take care of it.

Best Wishes,

Sue

If you are the one filing for divorce (bringing the action) you are the petitioner. If you are the one being serving with divorce papers (responding to the action) you are the respondent.

You are the petitioner, the one filing the case. The other party is the respondent, the one who has to respond to the charges.

LOL two different answers. Are you more confused now? You are petitioning for divorce so you are the petitioner. Your spouse will have to respond to the petition so they are the respondent. Make sense now?

The petitioner. The respondent is the person who will be served with the papers.

You are the petitioner, since you are petitioning/filing a complaint to the courts for a divorce.
