Did you call and talk to the sales person about it. Did you get a photo of the model # on the unit? Can you prove the unit was wrong. You will need more than just your word in court. You may have started a big problem by stopping the check.

Maybe just a phone call from him would spur some results. Then contact the local contractors licensing agency or department of metropolitan developement. The name may be slightly different, but just tell them that you want to lodge a complaint. They will direct you. The BBB wouldn't hurt either. This could be a matter of miscommunication. What did the contractor say when you called him to ask about the unit? Or did you just stop payment first? Perhaps the unit you did receive was a reasonable facsimile. Perhaps those specific units are on backorder. Could be just as good, suggest an extended warranty at no extra charge. Communicate and document everything you do from this point on. Presumably the contractor has taken the unit to return it and get the one you did order. Never mind the law make sure you get what you want...an upgraded AC unit. The contractor should have put back in your old system but perhaps figured you didnt need it? I hope your contractor is a good guy and doesnt screw you over somehow. Perhaps a telephone conversation to ask him whats going on might shed light on the matter and you can decide whether seeking protection under the law is the right way to go. For now holster that thought and call the guy.

Your timing was a little off. If the AC Unit was wrong you shouldn't have paid at that time.
Call the contractor & see where every things stands. If you didn't pay for the unit it wasn't yours. He may have taken it back because it was wrong.
You should call the police because AC units do get stolen.
If it was stolen it was yours & you would still owe the contractor.
I assume that it was just the outside unit that is gone & the parts in the house are still there.

your contractor may have made a bad legal mistake! getting all up in legal aspects is not the first place to start.if he is licensed he has to post a bond. be sure that you have the agreement in writing and you can file against his bond. call the licensing department in your state. you will get his attention! if he is unlicensed you may have difficulty.
