Well that's kind of tricky..

From a tax view.. You already paid tax on the pack so no it wouldn't be illegal.

From a not having a license to sell tobacco products.. I guess it would be..

Yes It is not lawfull.no and yes.and of course maybe. I was beaten for not selling someone a cig once and then taken to jail for that.so there you have a it a nice logical answer you were wonting.someone gave me a joint in jail once but I never could get a light so I traded it for some candy.and they didnt fine me or anything.technically illegal yes but no at the same time.& maybe.and yes I wish I could have found a light.no maybe about it.Peace
