It does depend on what state you live in. I recently had the same question and I googled my state's divorce laws. In my case, I needed to know what I had to gain and lose before taking that step. I know, sounds pathetic....Honestly I learned quite a bit. It answered all of my questions plus shed some light on alot of other things as well. It was quite helpful. You can also find a lawyer who will give you a free consultation....

if your in a community property state they are divide 50/50. Other states whatever each other ask for the judge determines who gets what.
