The native americans were given land by treaty. Each tribe has different treaties that define their reservations. Most of the land that was given to them was not land that anyone else really wanted at the time. Each reservation has its own rules on land use and who is allowed to live there. Just having a native American ancestor does not automatically give you the right to land - or even to be part of the reservation.

The reason is because of a treaty signed by the US and the Cherokee Nation. Yes I said "nation", most people do not realize that the native Americans here were and still are citizens of sovereign nations.. Keep in mind the land given was essentially worthless for anything, but it did keep the US government compliant with the terms of the treaty. As with any invasion and occupation of a country, the occupier eventually has to concede some reparations to the occupied.

Because they were removed from their original homelands uprooted to Oklahoma which was supposed to be Indian Territory and later their land was divided and doled out after Oklahoma became a state. But that was a long time ago. Are you asking why they are alloted land today? Because they aren't.

Its my understanding that because the tribe recognizes all it's people as a group, it is a birth right, yet they aren't really alloted land, they are alloted the right to use that land. They don't own it, the tribe owns it and their family has been alloted the right to use that land, that right is passed down from generation to generation.

Are you really asking this question seriously? First of all let's give an ethical answer: The Cherokee in historical past were very friendly and helpful to the settlers who first arrived here in the what is now the United States. And for a while the Chereokee and the colonists got along for a long while. Trading and living next to one another. Very early the Cherokee learned that a little conformity was a much safer course of action. But all of that changed when a little thing called Gold was discovered in Northern Georgia. Not a bottomless pit of Gold just one little discovery of one tiny gold mine in the hills of Northern Georgia. And natutrally to have a question as bold as yours you would have discovered that before the whites arrived The Cherokee Nation covered 8 States in the SE Region of the U.S. At the time of the discovery of gold the politicians in the American Government decided that the Cherokee didn't realize or appreciate the fruits that the Cherokee land produced. So President Jackson said hey let's set aside a parcel of land located in the desert regions of Oklahoma and call it an Indian Reservation. So in 1838 the Cherokees were forced from their own homes and walk from No. Georgia to Central Oklahoma in one of the harshest and coldest winters ever recorded in American History. Oh and the U.S. gov't sent them prepared too. Oh they provided blankets infested with Small Pox and whooping cough. And the freshest produce and meat but when the Cherokee received the food in was rotten and infested with maggots and worms. Not to mention being pushed and prodded along with whips and the tips of rifles in their backs. Over 2/3 of the Cherokee Nation either starved znd froze to death. Or the elements simply took the life out of them. Not to mention the diseases and sickness the gov't provided them all of which the Cherokee never encountered until the whites arrived. So in short the gov't took our land from us forcibly and attempted a mass extermination of the Cherokee People. All over one Gold mine in No. Georgia. And to this day that one gold mine still remains to be the only gold found in the territory that the Cherokee once proudly lived for centuries. All taken away by greed: The American Way of life. To take everything by force: The American Dream.

From a Political view. I was born and raised on the Qualla Boundary located in Cherokee, North Carolina. I am as recorded in national record 3/4 Cherokee and a1/4 of I have no idea. My tribe the Eastern Band Of the Cherokee do not live on a reservation because unlike most Native American tribes located in the U.S. my tribe owns every bit of land that my people reside on. We bought every bit of land that once belonged to us anyway, We bought back frome the U.S. gov't as well as the N.C. State gov't. And because of that one fact only members of the Eastern Band of the Cherokee can own or lease land located within the Qualla Boundary. But only land within that boundary are we directly entitled to receive land. All the land outside of that boundary falls to the laws of land ownership. Most tribes live on gov't owned land and fall prey to U.S. laws and controversy. My tribe we have our own gov't, police. schools, sanitation, DOT and hospitals and all of those entities are separate and answer to no local or national gov't agency. We ask and receive no funds or help of any form or fashion from The U.S. Gov't or local gov'ts for that matter. I went to an all Cherokee kids elementary school and high school. The True Cherokee History is a required course to graduate from Cherokee High School. Some of these facts you won't find in American History books because basically the gov't is hiding some of it and is I would imagine very embarassed. Even Hitler never disclosed all of his secrets. And in my opinion the American Government views and strong arm tactics can be directly compared and in some ways mirrorr one another. And that is Hitler and the holocaust.
