Child services?

Recently, my ex-husband stopped paying child support/spousal support. I could not afford to take him to court, so I filed with child services. Once I found since he was not following his court order, that my attorney would most likely be paid by him and child services could take 6 months to 1 yr to get my support payments I went ahead and hired an attorney. NOW, my ex hired an attorney who told my attorney that I HAVE to close the Child service case out in order to go against him in court. Is this true. I would hate to cancel child service and find that was BS. Thank you

Yes, it's true. You can't have two actions open against him for the same thing b/c then you'd end up with two support orders and the Courts won't let that happen.

Your attorney should know that......if they don't you need to go find another attorney. If you decide to stay with Child Support Services, you take comfort in knowing that you you should be getting CS back to the original date of the petition.....so it may take a while, but you should get your money. (That's the way it is in Arkansas at least).

Yes you do. Same in Georgia. You cant have two cases of the same suit filed in court at the same time. Child services are slow but have the most power in child support cases. They can get him to pay when attorneys can only get a court order.

the honor system doesnt work, thats for sure.

every state is different, so you need to call the local legal aid office; they are in all states and most counties. they are in the phone book or call the county court clerks office to get the number.

if you are on any kind of state aid, HE has to pay them back, and where i'm from (NJ) they are on it worse then the IRS.

my ex (after boohooing in court that he couldnt afford the payments) left court, hired an attorney whom said the same thing "he cant afford the payments" crap. needless to say, i respectfully requested the court to review his tax returns and found he was full of .......you know what. his own attorney didnt even bother to check his tax returns before writing that letter to the court (which also asked the arrest warrent be dropped) and i reported her azz to the state for it. they are supposed to find out the facts before writing a letter like that.

I do believe the child services works with the courts. Your lawyer should know this answer. You can also call the clerk at the court and ask them.

NOOOOO.... Once a case is open .... its open its all money owed.... unless you go to court with HIM and have it closed .... I did it and I regreded it... leave it open .... money is calculating...its called back pay... if he has property the will put lien on anything he owns...He's lying to you... don't trust him
