I have three kids by the same man. The middle child has has dads surname. I have split from him and he's now denying being their father. Can I change my childs name or not because he has parental responsibilty of him?? Will i need his approval??

he does need to be consulted and he will need to sigh the paper work unless you can prove he is mentally incompetent. The person who changes your sons name may also charge you, about 5 years ago a friend did change her sons name to the baby's father after they got married and they were charged £100. You may be able o get legal aid for this but i cant guarantee with the new legal aid rules. I would advice you to take legal advice you can get 1/2 hour free with some places just check your local news paper and ask all your questions then.

I don't know if you can change his legal name without the father's consent BUT you can call him what you like. Anyone can call themselves whatever they like. All they have to do is tell people!

The only thing you have to be aware of is that when you are filling in documents where the legal name is required you might have to state his legal surname.

When I was at school I used to different surname to the one I was born with as my mother was using her partner's (my sisters' father) surname but I never had my name legally changed.

Just change it by deed poll - thats what I did with my daughter. Then notify everyone except your ex - so doctors, school, change her medical card - everything and you wont have a problem. It doesnt cause problems as by the time your daughter is old enough to want to get married or anything - the fact she has used her new name for so many years will allow her to be married under the new name as well. Even applying for a passport - all you need is a letter from you stating that you want her to be known under the new name and they accept it as okay. Good luck xxx

I changed my daughters name by deed poll, i kept it quiet from the father, after about a year he found out and was meant to be making an application to court to dispute it, even if he did ths now it would prob be to late because she knows herself as my name and has started school now. He didn't have PR though. The longer you can keep it quiet the better Good luck

You will need his approval to have it changed and the money for the court cost to have it changed. My daughter had my maiden name and when her father and I got divorced I signed in the divorce papers that he could legally change her name.
I believe you can ask for a name change but he can contest it.

Yes you will need his approval to do so unless you can prove abandonment which is typically difficult to do. Most lawyers will do a free consultation, I would contact one and see what he/she thinks...you need to get set up with child support also.

If he has parental responsibility ie you were married, it was granted by a court or the child was born after Dec 2004, you will need his consent to change the child's name, or a court ruling permitting you to do it if he disagrees.

if youre in the uk.........you wont need his permission no hun, and you dont even have to do it by deedpoll....just choose to change his name to your maiden name, and let schools and doctors know etc...when it comes round to him having a passport, you put his new surname in, has to be your maiden name, and send off your marriage certificate along with your birth certificate. ive actually also heard that you can have his name changed on his birth certificate for a small fee too, but id ring your local registra for that info hun.

WOW! I'm dating my age here! When my boys were young all I had to do was go to the court house and pay the fee and presto, it was done. Thing have sure changed.
