Not sure but he originally signed a contract to play Spider-Man / Peter Parker for 3 films. They have alot of story lines that they can bring in vis a vie: Carnage (Cletus Kassidy), Team-ups (X-Men and Daredevil)

Maguire has said that a 4th Spider Man film is unlikely, but several rumors online say the 4th film has been "greenlighted."
After Spiderman 3, Maguire will star in "The Good German" which is being produced by George Clooney.
