It has its good and bad sides. It's made the judicial branch much too powerful in my opinion but it's also the only way to insure that the legislature can't override constitutionally protected rights on a whim. Is it constitutional? It seems that we can interpret the constitution to mean anything we want nowadays.

Obviously it's constitutional--someone has to rule on what is constitutional and that has been given to the Supreme Court by the constitution. It is good because sometimes the majority just doesn't feel like being fair, and needs a check against their power to hinder the freedom of those in the minority opinion.
