What an absolute eejit. I hate men like this. What about going for a free consultation with Ross Harper or somewhere similar? Make sure you have all your knowlege of what this fool has been up to, dates, names, addresses, where he has been working etc.. written or even better typed out for them.

Don't even bother with the CSA - they are total rubbish! They assessed my ex to pay a decent amount each month,as he was in a well paid job. As a result I didn't go for any maintenance for myself, as with the amount the CSA had decided upon and a small part time job, I figured I had enough to get a mortgage on a smaller property for myself and my kids. Three weeks after I moved out and into a little flat, I got notification from the CSA that my ex had appealed and that they had decided to reduce his assessment to 10% of the original figure (which he had never paid), leaving me with less than £10 per week maintenance! Dealing with the CSA and trying to get things sorted out was ten times more stressful than the divorce and house move put together! I never really ever got the maintenance I should have been paid. It was a real struggle. If you are on benefits yourself I think you are obliged to go through the CSA or it's replacement, but a good family law solicitor should be able to advise you on this. If you are not on benefits you may be able to do it through court and you may be eligible for legal aid, again, a solicitor should be able to advise you on this. Some solicitors don't charge for an initial consultation, so it's worth ringing around to find out who offers this. I'm not sure that the new CSA replacement will be any better than the CSA was, as the CSA was supposed to have powers to deduct money direct from absent parents, but were so inept and incompetent that they rarely did, or if they did, they took 12 months to do it! Best of luck - you have my sympathy!

Sorry I might not be of much help , because I don't know how these things work in Scotland. But you need to file a child support order with the division of Child Support Enforcement whether he has a real job now or not he will be liable for back child support in in the U.S THERE ARE MANY PENALTIES INVOLVED WITH THAT, including jail time. That's just a suggestion but me personally rather than go through all that and not really get anything I will take care of my kids the best way I can at let, their father not being apart of their life be there problem.When they grow up an become very important people he will be sorry!!!! Not sure I am assuming the csa is like welfare in the states. I live in PA and can't get child support because my kids father lives off of welfare with his wife and the 3 kids they had in the last 2 years, they also have #4 on the way. All I can say is good luck. It sucks that a man can support his whole family off of the government and keep having kids for us to pay for, and then isn't obligated to pay for the other children. . . . .We need hard labor prisons for them.

I'm in Canada and for the past six months my daughter's father has decided that he's not going to pay his support. He truly thought because I re-married that his obligation to be a father and support her had ended.
I started from day one of the missed payment on his back and theirs. I have logged so many calls to them with every excuse he has handed me and them.
Finally, I got someone on the phone that really took a look at it and said REGARDLESS of whether he pays anything this month or not that she was recommending that he be held in default for the back support and taken to court. It's not the first time he's done it. And because he figures he doesn't have a license to loose he'll have nothing done to him. Wrong again. They are asking for jail time.
My point is this; be persistant. The cause is worthy, it's your children. The agency doesn't care if you don't care. Be the squeaky wheel and don't stop until you get someone that is willing to do something. Your children depend on it.

It is illegal to claim benefits and work on the side. If you were to grass him up to the social for that (and you should) then that's all that would happen is that he would quit the work and you would be in the same situation. As for going to court, remember, what he is doing is illegal and they will fine him not award you any of the money.

How are things in Scotland, by the way.
Now, not knowing anything about the child support laws in Scotland, you may be able to prove he is working on the side by hiring a private investigator.

When I divorced my husband he was making atleast $1,200 a week and when he found out he had to pay me a measley $600 a month for our daughter he quit working to a life of crime he is in prison as we speak owes me almost $40,000 and he feels because I'm with another man that he should pay for his daughter which he has but I do not think it's fair.

im not sure how this works where you are but good luck to you i am in a similar situation my sons father is not a us citizen and when they went after him for child support he would not cooperate they wont do anything to him good or bad for not paying because they said him not being a us citizen makes them unable to force him to do anything.
