On the one hand,no one goes out and says"I'm going to drive drunk so I can kill someone".On the other hand,after so much advertisement,they say don't drink and drive.Get a designated driver,Have someone call a cab.

the answer is because the dead can not testify. therefore there is no witness except the drunk one.

its funny, in alaska they had driver who had been caught more than ten times repeatedly. So they came up with light sentences for first timers and increasing punishments for repeat offenders. They still had a repeat offender Kill someone
Some people believe it or not forget they are drunk when they take off, many people lose their ability to make wise choices and their judgments are impaired. No One drunk or sober who have some amount of consciencness, will ever desire to Kill someone while under the influence.

well mate the thing is you cannot kill the drunkard just like he killed somebody else , its a grave offence i know but then in India the punishment is not meagre , it could go on to 7 years as well and the case is registered for negligent driving . but yeah that's another thing that in India , that the way the lawyers produce the evidence most of the times the drunkard driver goes Scott-free
