ok.. very complicated question...
in some states the age of 14 they can talk for themselves and "ask" to live with a certain parent. But the judge also considers the best interest of the child.
Is the child thriving where he/she is now?
Is the parent able to provide for the child as the parent he/she is living with?
How long the child has been living with the custodial parent?
Patterns of the NCP and the custodial parent.
My husband gain custody of his daughter when she was around 2.5 years old. Not every situation they give custody to the mother. It is what is in the "best interest of the child", in this case the mother was not the best interest. She had made poor choices..

I am a social worker and when we take kids away from their family they can refuse to be adopted at the age of 14, they can choose their adoptive parent. At the age of 14 kids are allowed to speak for themselves, at 13 and under the court appoints them a guardian ad litem 14 and above an advocate, this person has to do what the child says (the advoacate and gaurdian are attorneys) So the answer is 14 (in most states)

If the child is above the age of 7 the judge asks the child before deciding the custody at the time of decree.

Yeah it should be the childs choice, I'm 15 years old and I remember when I was really little I hated going to my dads house. I absolutely hated it, I was stil forced to go because "court orders." Now that I'm older and have more of a voice I don't go and see him at all. There was never really a bond between us and there's no relationship there. I think it's too late to even start one. Sadly that is my dad but, it turned out this way.
BUT ANYWAY It's pretty much on the judge you have and if they think you're a fit parent. =]

i believe it depends on the state in which you live in but in South Dakota i believe the age a childs voice is heard is 12 but the judge still has to make the final decision

They don't always have a set age.........it is suppose to be..........what would be best for the child..........If the child is of a understanding age 12/13 they might ask then.
