My cousin was leaving a large department store at the same time that an alleged shoplifter was leaving the store. My cousin got in her car, and 2 security officers came up to her car asking her to get out of the car and to return any stolen merchandise. She panicked and drove off while the men yelled out that she was going to go to jail and they also recorded her license plate. Is she going to be charged for any type of crime here in California since she did not comply with the security to get out of the car? What should I do to help my cousin?

dont worry about it.There are no grounds for a charge here, they have no physical evidence, and not enough circumstancial evidence, but they will have the right to refuse her from the store

I had something similar happen at a gas station. I put my credit card in the machine, pumped my gas and got in my car to leave. The cashier came running out...I saw him behind my car, I could not tell what he was doing, so waited a sec and watched him in the mirror. He then pounded on my window. At this point I was little scared and opened the window a crack with my other hand on my cell phone, even though I knew he worked there. He said"I wrote your plate down! You didnt pay for your gas! I am calling the police!" I said
"I paid in the machine, here is my receipt, you f---ing idiot" I threw the receipt at him and drove off. I called the main corporate office the next day, I would advise your cousin to call the store manager and explain the situation.

They have NO RIGHT to search her car....honestly people are such sheep sometimes.

Get a good lawyer. If she had allowed them to search her vehicle and stuff, they would have found that she had done nothing illegal and wasn't the shoplifter. Her running makes her appear very guilty. I have nothing to hide and would have let them search the vehicle and cooperated to clear myself.

Good luck with that,

Sue
