I think you mean secede....and under the Constitution and the spirit of the Declaration of Independence, they would be able to, but Uncle Sam won't allow for that freedom. That's what the Civil War was fought over.... not slavery. And the states lost to the federal government. Our rights have been slowly eroded away ever since.

I believe you're asking if a state can SECEDE? The state legislature must agree by 2/3 vote on that issue,then it goes to Congress who must also allow this to happen by 2/3 vote as well. If it doesn't pass at the stae or federal levels,then that state may NOT secede.
When Texas went from an independent republic to a becoming the 29th state in 1849 ,it was understood AND agreed that it could secede at any time with 2/3 vote from the state legislature WITHOUT approval from Congress to return to being a republic and seperate country again.

Did you mean can they secede?
Are there any that want to? The last time any state wanted to secede, they had to fight to ensure that they could and they lost the fight. There aren't any states that want to secede. And indeed, why would they secede?
