I have been separated from my abusive husband for the last six years. However, I have ask him to agree to a divorce so that both of us are able to move on with our lives. He stated that we will be married until death does us apart. We have one son that he refuse to pay support for. I have contact all child support agencies in my area, but they are unable to find him. His mother states that he is homeless and worthless. She stated that I should move on with my life because he is a lost cause. I stated to her how he is unwilling to sign any divorce papers. He very seldom calls to speak with his son and when he does he is very abusive verbally and questions him about me. My son really doesn't understand because he is young. He thinks that his dad died and went to heaven. Nevertheless, I don't have much money after paying bills and childcare. Is there anyone who has information or advice on what I can do?

Get an attorney that can get the divorce done without finding him, I am sure this can be done because people go MIA-missing in Action all the time and they are granted such. If will be married till death do us apart...that makes me nervous hearing that and you should be to. At this point without finding him just forget him and worry about child support if he ever comes back or re-appears. If that happens then you might consider an protective order against him, sounds like he could be dangerous for two reasons, till death do us apart and the fact that he abused you during the relationship.

LISTEN TO ME NOW! dont be a battered wife and dont you dare go back to him even if he comes back on hands and knees. Once an abuser always an abuser.

Move on honey now...if you can afford a cheap divorce right now, then wait till you have the money. check out cheap state run type attorney offices that are cheaper then normal, usually up and running attorney that just passed the bar.....call the bar association in your area.

Wake up. be cautious and protect you and your child, dont let him run your life from afar. worry about child support when he re-surfaces. His mother could be very well lying to you, maybe not as to where his where abouts is. The day you least expect it someone he knew or his family knew or someone you barely knew that knew him or even someone you might be very close to will call you, stop by your home or leave you a secret note saying where his where abouts is and or where he is hiding.

Wake up...dont take him back regardless...because he will try again someday...protect yourself...and find a new man that will treat you like a lady and be a father he never has been to your boy.

File divorce papers, eventually, if he doesn't sign, you will be awarded the divorce. You can find samples online that might help you, make sure you get the correct language for one that involves kids. You will also want to get custody of your son, and that is another document. And you need to make sure that you are very careful about what you put in there, that there are no 'loop holes.' Whether he has a job or not, I believe that you can be awarded some kind of monetary amount and he would be told he needs to get a job by the Court, unless he has some kind of disability that prevents him from working, and if that was the case, your son could draw from his disability. If he doesn't pay, then he can get contempt charges thrown against him and thrown in jail. My philosophy used to be, if I wasn't getting paid, then I don't care if he's in jail - either way, I won't be getting paid. Best of luck to you - I know how hard it is to do this on your own - my ex did the same to me. Also, depending on your state you might have to wait to file - but you can work on the custody papers. My state I have to be legally seperated for a year.

Alright I also went through a divorce in my early 20's and wanted a cheap alternative also if you have a book store in your area it's a great way to start, they have divorce for dummies and many other good books that walk you right through it and some have some documents in them, they make it easy and cheap

Contact your state Bar Association, and explain your problem. They can advise you as to what your avenues and options are. In most states, you can get free legal assistance through the courts. You may have to pay to advertise the divorce hearing, but if you stick with it, you will be free of your husband. Depending on your state, you may also be able to get assistance, for a time.

You file for divorce. The courts in most instants will make him pay the court cost and lawyer fees and new laws for FOC they garnish paychecks to make sure support is paid. If you explain that you can not locate your estranged husband or get him to corporate, the divorce will proceed with out him and he will get run through the ringer you on the other hand could get full custody and some more verbal abuse from your soon to be X. There are counselors and all kinds of resources for single parents. Look in to them. The courts and FOC (friend of the court) all have info for you to check in to.

contact the state attorney generals office for child support help chances are they will order chils support be paid when he goes into default on his payments they will issue an arrest warrant you can divorce him while he is in jail for a very small fee, you will also have to ask the atty general about that.

Check around for attornies taking pro-bono work through your local courts and social programs. You can get divorced without him, if necessary, and probably for free or on a reasonable payment plan.

Don't know where live but in Georgia we have legal aid,they base there help on how much money you have.You don't think you can find him then take the police to get him or child support recovery to get him.Again in Georgia if a person don't support they go to jail I know what you are going to think well if they are in jail they cant pay.The parole officer and child support recovery meet with him or her when they get out of prison and tell them what is what then they go back to court the judge set them what they will pay a month plus to get back support caught up,most people dont want to go back to jail.You know you can get help from the state you live in for you and the child if you can take time of and get it.
