No. Who would define what "desecration" means?

Would we ban products made of the flag or portions thereof? Would we ban burning? Burning the flag is the preferred method of disposal, so basically we would be banning disrespect. That's a slippery slope.

I am not sure, but there is a Act of Congress that forbids letting the flag touch the ground. If it touches the ground, it is to be burned. It is to be taken down at night if it is not lit by a floodlight or other light source. There may be other parts to that Act also. I would think that even if it touches the ground by accident would be desecration, then burning, urinating, wiping your butt on it, or anything that would be disrespectful to the flag would be desecration also. However, the way our country is falling apart, who would enforce it except We the People?

IMHO, the only people who would want to desecrate the flag are those who are unhappy with the country and its government, and should be allowed to do so to express themselves if they choose to do it that way, especially in the US where we have freedom of expression. I personally would not desecrate a flag, but I guess I'm not sure why it should be a law that people cannot. And how do you decide who does it on purpose and who's done it on accident, and what is art and what is not art, etc. It would be difficult to enforce.

Yes.
Freedom of speech is one thing. But to desecrate the flag is a complete lack of respect. If you hate the country so bad that you feel you need to desecrate the flag, then leave. It's a simple as that.

Trouble is that flag desecration is considered speech, more specifically political speech, which is afforded the strictest constitutional protection. More general laws not involving speech could be enforced ie. no public burning, disorderly conduct, inciting a riot.
Query? If flag burning is "speech" could it also be considered "fighting words" which are not protected by the first amendment?
More importantly doesn't everybody, Congress, the Supreme Court, whacko liberal demonstators and wild eyed guns, god and guts reactionaries all have more productive things to argue about and to devote their time?

There already is a law for that! It's illegal to burn a flag or desecrate it! Or at least I thought it was illegal, because I have known people to go to jail for burning a flag!

Nope. WHO does it hurt if flags are attacked? All flags should be afforded equal respect as symbols. If folks start to get over-sensitive about those symbols, then we are wide open to having our buttons pressed again and again.

Yes, it's our flag and every country in the world, respects its flag. You don't always have to agree with whom is running the country from the WH and the policies set forth by whomever is there but always, ALWAYS respect your flag - too many good people have given up their lives for it and in defense of it.

In NYS flag burning is not an offense, as it is protected by the constitution, However, it is illegal to start a fire outside in public....could be reckless endangerment, and possibly arson.
