illegal downloading is punishable by law ,for each work is protected by copyrights ,or ? it should be better protected ? ,but ,i also think that it is a lure ,it is made available to the public , knowing that the average person ,will be tempted to take one other's belonging ,without permission because of availability ,and ease .......whether it is music or video ,images etc.
First, it is practically impossible to enforce a sanction against the downloader. Without a subpoena, a police officer is powerless to demand a computer search and a search warrant can’t be obtained without probable cause. Some universities have tried to use ISP records to enforce file sharing laws, but this method is inadequate for use on the general populace and is rarely accepted in court. For the vast majority of America, the circular burden of proof necessary download sanction’s enforcement renders it powerless. The second reason why a law making downloading illegal is ineffective is that a downloader has no way of knowing what music is legal and what is copyrighted. It isn’t as if a peer to peer user loads up the internet thinking “what can I pirate today.” Rather a music search is conducted based on title or artist and a download occurs with the user completely oblivious to the legal status of the file she is downloading.
