Recently, my ex-husband stopped paying child support/spousal support. I could not afford to take him to court, so I filed with child services. Once I found since he was not following his court order, that my attorney would most likely be paid by him and child services could take 6 months to 1 yr to get my support payments I went ahead and hired an attorney. NOW, my ex hired an attorney who told my attorney that I HAVE to close the Child service case out in order to go against him in court. Is this true. I would hate to cancel child service and find that was BS. Thank you

not collecting welfare or any other type of gov. income. Ex- is an engineer and I in the mtg. business. Ex only had child 6-8 times this year and barely shows interest in his son.

depending on state you live in, some states ask you if you have opened a case with child service they ask you to close them to make arragements through the court. I would call child services and ask them if your state requires you to close if you are getting help through other services like food stamps or temp cash assistance then I know that the state will handle by their selves. I would look into more detail with child services before dropping it.

i dont know what state you are in but in new york if someone stopps paying suport you can go to family court and file papers without an attorney...call your local family courts and ask them for help..they will guide you and even help you fill out the right paper work..you can even have your ex husbands salary garnished!!!

Every city has a Legal Aid Society.....pay them a visit so you can get some help with this problem.

talk to legal aid in your county, some, like mine only charge you 10 bucks for 15 minute legal advice.
