in a custody case if my ex refuse`s to take a hair folical drug test is it the same as admitting guilt? or is it a right to refuse?

refusal to submit to exam = GUILTY
So yes they can refuse, but it will not help.....them anyway. You will likely be overjoyed if they refuse. Not only do you win, but they'll be cited for contempt!

If it replaced into ordered and refused, that's contempt of court docket. penal complex or heavy high quality could be in touch. Then it may be ordered lower back. If refused, a similar. many times till that's complete to the courts delight.

If it was ordered and refused, that is contempt of court. Jail or heavy fine would be involved. Then it would be ordered again. If refused, the same. Over and over until it is done to the courts satisfaction.
