Heres the situation, if man gets a woman extremely drunk and sleeps with her, he can realisticly ba charged with rape. But a few nights ago I got obsenely drunk at some chick's party and ended up sleeping with her. She was sober and honeslty, pretty damned ugly. Can I charge her with rape?

In realistic point of view, if you are serious (somehow I doubt it), it is harder for a male to prove any form of molestation or rape over a certain age. Generally the court will state that you were willing to become drunk and it was a bad judgment made on your own. A one night stand with an ugly woman is technically not rape. In technicality you stated the man got her drunk, then perhaps she had the right to file. The court will consider whether or not she was given the choice to option out of drinking or if she knew her own tolerance for alcohol. The same goes for a man. However, you stated that you had just happened to get drunk. Unless she could force you in some fashion or form, then you have no real case.

From a purely logical perspective, yes, this is just as much rape as the reverse. Many people believe that a man cannot be raped by a woman, since an erection implies consent. Any teen aged boy will agree that men can posses an erection and still be in abject terror.

However, the law tends to regard men as natural sexual predators, and women as the prey. This is not entirely inaccurate, as the vast majority of sexual assaults are by men, usually against women.

So, although you might have a logical platform from which to argue you were raped, realistically, you have no chance of prevailing, and would most likely be ridiculed socially for the action.

I would assume that if you can prove that you were inebriated to the point that you could no longer function and make rational decisions, then you should consult your local prosecuting attorney.
The problem here being that you are a man and most women think that men will sleep with anything. I say force the issue, let's see if works both ways.
BTW, don't use the "pretty damned ugly" in your statement to police.

Unless she slipped you a date rape drug, something that would
cause you to be semi-concious and erect at the same time, trying to have her charged with rape would be a complete waste of time. Not because she's morally innocent of some form of rape, but because no jury in it's right mind would convict on what
you've stated.

Its difficult to say a man was an unwilling victim, as you have to have a certain amount of excitement to be involved. Perhaps alcohol avoidance and/or counseling is the more appropriate action you could take at this time.

Rape laws very state by state. In some states, California for example, you could conceivably make a case for rape. It would be a bit of a stretch though.

If you charge her you will be such an idiot. Just because she was 'Pretty damned ugly' and you got drunk and slept with her doesn't mean you should get to send her away in jail or get paid. It is your own fault. Just because she took advantage of you doesn't mean it is rape.

No, because you are a man. Men cannot ever be raped, unless it's by another man. we call this the double standard, and women aren't complaining because for once it benefits them. We call that hypocrisy.
