I accepted an offer on a job last week (let's call it Company A) but my dream job came up a few days later (Company B). I have signed an offer letter to confirm my start date with Company A as 20th Dec but have not signed the contract as yet. I plan to call the Company A tomorrow and tell them that I want to accept the other job with Company B (better salary/hours/prospects) but need to know where I stand. Does anyone happen to know whether an acceptance of an offer is still binding even though the contract has yet to be signed and my start date is still a week away? Thanks x

>Technically< if you have formally accepted with company A, they do have some legal redress even though you haven't signed a contract. It is unlikely that they will pursue it though. It would cost more in administration and legal fees than the amount of redress sought.

To cover your behind, in a legal sense, you could request a written acceptance of your withdrawl from the offer, but as I say, for most cases it is not economically sensible for Company A to pursue such a claim.

If you signed an offer letter with Company A and you wish to take the offer from Company B than you must contact Company A and inform them that you wish to decline their offer.

If you have not started yet than with Company A all should be ok because all you did was sign the offer letter.

Make sure you follow through in writing just in case.

The offer letter in question if I'm not mistaken isn't binding until you sign the actual contract which would make you an employee of "Company A" hope this helps - Go for Company B :o) Good luck!!!!!

as a business major in college I can tell you without a doubt that unless you have signed a contract then all you really need to do is decline the offer from company a and accept the offer from company b

Nope, I work for a recruitment agency and I can categorically tell you that unless you have signed you are in the clear.

Believe me I've seen enough companies stuff candidates when it has been the other way round!

Even if you had signed you could still walk away and they couldn't do anything except be a bit peed off.
