I've a problem. I live in an apartment and the neighbors under me smoke night and day I swear! The smoke ends up in my apartment and so my entire apartment smells like a smoking room!!! I've tried everything; telling the managers, asking the neighbors to stop (they just started to smoke even more), even using one of those air cleaners. Right now my only choice is to move but I sooo don't want to!! PLEASE help!!!

In a lot of states there are laws about that. Many places say you cannot smoke in proximity to where people live and work. Because the smoke is actually coming into your house, your neighbors may be violating housing laws. It depends on which state you are in, but if you have a housing commission or sue such body, you can ask them. It's possible you could even sue your landlord for not taking care of it.

If there is not a regulation against smoking in the apartment - there is not much you can do to stop them. If your heat is included - you could turn up the heat and keep a window open through the winter which should help quite a bit. Air cleaners really don't do much other than add new smells. You could definitely try getting your landlord to pay for a carpet cleaning (assuming you have carpets) and wipe the walls down with a water and vinegar solution - vinegar seems to cut through anything.

Put a nicely rapped package on the neighbors doorstep for Christmas containing a note that asks very politely that they try to ventilate there smoke out of the windows of their apartment so that you don't get so much diffused through the floor into your apartment. Be sure that the package also contains a sponge soaked with liver of sulfate or some other stinky substance. If this does not help immediately continue applying the same stinky substance to the door mat every day until they comply.

Do what you can to NOT be responsible for him. You spoken to him repeatedly, but he's ignored you. Stop making yourself crazy with the additional asking already. I highly doubt that the 101st time you say it that anything will be different as far as he's concerned. Also, the next time the landlord comes, tell him that you've been doing all you can to get him to stop without success. Then tell him to talk to your roommate, not YOU. Don't let yourself get caught up in tihs. The simple fact is that your roommate and his friends are jeopardizing YOUR housing and you certainly don't want to have an eviction notice on your record--it could interfere with your getting housing down the road. This is not at all about being a rat. It IS about your health, your housing, and not losing your share of any deposit you paid. It is also about his "disrespecting the house". Since this has been going on so long and he is constantly disrespecting you AND the landlord, I think that the important thing to do is to get financially prepared: --You save as much money as you can so you can be prepared when, and if, you get evicted. The landlord doesn't just have to evict only him; he can get rid of ANYbody who lives at your address, including you. Doesn't matter if you're innocent or not. --Consider going to your landlord and having a talk about the situation and to *request* that your roommate be evicted. Let him know that you've been trying to remedy the situation to his satisfaction and in accordance with the lease without success. Ask him to evict the nimcompoop already. --If the landlord evicts him and lets you stay, then you still need to save to cover the rent until you find a more responsible roommate. Unless the landlord talks, your roommate doesn't need to know that you did this. Good luck.

You have two choices: Move or deal with it. You have no right to tell your neighbors what to do in their own home. I know that I wouldn't let my neighbors tell me that I can't smoke in my own home, I pay the rent where I am and I won't allow someone else tell me rules of my home.

That really sucks and I was also in the same situation. It used to make my clothing stink like if I was a smoker which was really embarassing. What we did was just use incense. They really helped out a lot. We also just made sure we opened up the windows for a while to let the apartment vent with some incense on. It really helped us out. Try it out maybe it will help you. You can also try finding smokers candles that help eliminate odors. Good luck to you..

I you don't want to move, then maybe you should just deal with it.. obviously no one else cares about them smoking.. if u have a problem with the smell then use air fresheners, candles or anything scented

this sucks for you cause it seems to me that they are probably chain smokers and ppl like that arent gonna stop quickly enough i guess since u have tried talking to everyone who can help the situation and they havent the best things to do are keep insisting or i guess your just going to have to move out sorry

OK go to a fun shop and buy those little capsules also known as stink bombs and crush them in front of there doorway at night or on there door and the stink will propagate into there apartment making it stink like rotten eggs
