they will now have a combined income and they got married last week .we are going to court next week and wantyed to know if I can ask for the payments to be increased

Before anyone gets ideas that i am after him for the money that is not the question ....he only gives me 25 dollars a month because he takes false paystubs and his boss helps him do that since they pay him off the books and i am not greedya nd I do go to church for those who assume that I dont ...I dont want to make this an issue but i was in a car accident that ended my career as a EMT for the new york city fire department so i need the help all i asked was for him to get me the things the baby needed and nothing else not the money or anything but he told me to take him to court and i did so that is why i asked about that so please do not assume i am a greedy money hungry woman but i didnt make this baby alone and he was there until he got caught cheating on me with her

They will only go by him pay not hers because the child is between you and your ex.

No, she is not obligated to pay strickly because she married your ex. However, regardless of what the law says, could you in good conscience ask her to pay child support for a child that is not her's. Not to say that she doesn't care or would not be willing to help, but that is not the point. The idea behind child support is not getting as much money as possible out of the other parent, it is about sharing responsibility for the life that the two of you created. I can certainly understand that you have gone through and may still be harboring heartache but you should not let it blind you from what is fair and right. Take care, Jack of Hearts

Nope she's not obligated to pay. So you have to have a lawyer on your behalf work with his lawyer to make sure that he isn't conveniently "not making money" anymore
To make sure that you do get paid, you can go to court to get the payments garnished from his paycheck , so that its to you prior to him depositing it into any bank account.

u can ask for increase in payments but its not the new wife's responsibility unless she adopts him (and that means giving up ur rights to the child)

NO! You can only get "his" wages, and not thier combined wages...
"She" didnt divorce you...Nor, should she pay for her husbands choice of "ex wives"...
You sound very money grabbing to want to suck the money out of the new wife...bitter too, I may add...

no, your children are not her obligation.but in the same breath,if she is ever to sign the child support check you can consider it a gift for that same reason.
