I live in NC and my former landlord lives in FL. They refuse to return my deposit and half months rent and won't take my phone calls anymore. I want to sue to get my money back. Can I sue here in NC because they own property here, or do I have file where they live in FL?

You should file there in NC. Since the property that you rented is in NC, that is where you should file.

You will file in your county's small claims court. However, you will have to hire a process server where your former landlord lives in FL to serve the legal action papers.

You werent clear on where the property you rented was, none the less where ever you rented the property is where you would have to file a suit. If however you rented in NC then you can sue there. You have to do it where the residence you rented/ leased was. States have different laws regarding contracts/leases etc. and a State Superior Court deals with state statutes.

I'd wager that your old lease answers that question. Probably locally.

You might want to check with an attorney to see if you even have a case.

I would say contact a lawyer in your state, they might refer you to someone but at least they could tell you whether you have a case or not.
