my friend mandy found a check that was signed and filled out for around 1000 dollars but not made out to anyone so she put her name on it and cashed it she got a call from a detective investigaging check fraud she is scared shitless she figured it was like finding money kinda stupid i think but what is going to happen to her can she get in some real truouble or do you think she can get off this is the only thing she has ever done other than tickets what do you think??

Yes, you can get in serious trouble for this. It may even be a federal crime, though I am not sure.

Of course she will go to jail. She knowingly put her name on a check that was not intended for her, and cashed it. The top of the check had a persons name or a company's name. She should have done the right thing, and destroyed it. Did she tell the detective the truth? Best bet is to get a plea bargain, and get prepared to pay the money back.

"Uttering a forged instrument". It was not her check, she knowingly filled in the check in full knowledge it was not hers to cash. She will likely be told that ignorance of the law is no excuse, because she knew for fact that the check was not hers. The sentence depends on the county, city or state she lives in. Not too wise. $1000.00 or more is Grand Larceny.

If she has a clean record, a good lawyer and this is her first offense, they will probably let her off with paying restitution and probation. I must admit this sounds a bit contrived, who leaves a check for $1000.00 made out to no one lying around?

Since 1000 dollars is a considerable sum of money, yes she (you) could go to jail. It is called theft. And the amount is large enough to qualify as a felony.

yea, she is in trouble... if she still has the money and gives it back then the law may go easier on her. I can't remember if that amount makes it a felony or misdemeanor. if it is a felony then she better get ready for a really close relationship with her new cell mate Hilda.
